death by shrimp
this story interests me for a few reasons: 1) while at nyu, i used to be friends with the daughter of benihana's owner; 2) this happened in a town a few friends are from; 3) another sign that Americans are overly-litigious (this coming from a soon to be lawyer!)
basically, a man was dining at benihana's, a chain hibachi restaurant. if you've ever been a japanese steakhouse, then you've either seen or had the experience of a chef grilling your meal in front of you while entertaining you by throwing food in the air for you to eat or his pocket/hat to catch. anyway, so a many apparently threw out his neck trying to catch a shrimp. he supposedly suffered a neck injury. an unrelated neck injury required surgery, which led to an infection which led to his death. now his famiy is suing benihana's.
and we wonder why the rest of the world laughs at americans.

ahh stupid americans - poor guy - that isnt a great way to go - now let's guess the defenses ---- assumption of risk? lack of causation?
i'd go with both defenses. =)
